PUBLIC NOTICE OF THE TOWN OF CAVE CREEK
 AND ORDER CALLING SPECIAL ELECTION 

             Notice is hereby given, and it is hereby Ordered, that the Town of Cave Creek will hold a Special Recall Election at the same time as the General Election scheduled for Tuesday, November 4, 2014.
Date of Cave Creek Special Recall Election:  Tuesday, November 4, 2014.

Offices to be Filled:

             1.         Town Council seat currently held by Council Member Mike Durkin, whose name will automatically appear on the ballot as a candidate; and
            2.         Town Council seat currently held by Council Member Charles Spitzer, whose name will automatically appear on the ballot as a candidate.

Procedure and Schedule for Filing of Nominating Petitions by Other Candidates:  
             Nominating Petitions must be filed separately in opposition to either Council Member Durkin or to Council Member Spitzer;
            Each opposition candidate may file Nominating Petitions in opposition to only one Council Member, not both;

             Petitions must be filed no earlier than 90 days prior to the election day--that is, no earlier than WEDNESDAY, AUGUST 6, 2014; and
            Petitions must be filed no later than 60 days prior to the election day--that is, no later than FRIDAY, SEPTEMBER 5, 2014.

AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF CAVE CREEK, MARICOPA COUNTY, ARIZONA, AMENDING THE OFFICIAL TOWN OF CAVE CREEK ZONING MAP BY CHANGING THE UNDERLYING ZONE OF PARCELS 211-47-101A AND 211-47-102A, DESCRIBED IN EXHIBIT 1 AND DEPICTED IN EXHIBIT 2, FROM DESERT RURAL (DR-89) TO A GENERAL COMMERCIAL (GC) ZONE. THE SUBJECT PARCELS ARE LOCATED NORTHWEST OF THE INTERSECTION OF CAREFREE HIGHWAY AND CAVE CREEK ROAD BETWEEN 54TH AND 53RD STREETS.
DESCRIPTIVE TITLE

Ordinance No. O2012-08 would amend the zoning map to reflect that two (2) parcels having Assessor’s Parcel numbers 211-47-101A and 211-47-102A and located northwest of the intersection of Carefree Highway and Cave Creek Road between 54th and 53rd Streets be hereafter rezoned from Desert Rural (DR-89) to General Commercial (GC).

A ‘YES’ vote shall have the effect of affirming the Town Council vote and shall approve Ordinance No. O2012-08 and shall amend the zoning map of the Town of Cave Creek.

A ‘NO’ vote shall have the effect of not approving Ordinance No. O2012-08 and shall not amend the zoning map of the Town of Cave Creek.


ARGUMENTS FOR THE PUBLICITY PAMPHLET ARE DUE BEFORE 5:00PM ON WEDNESDAY, FEBRUARY 20, 2013 AT TOWN HALL. ARGUMENTS ARE LIMITED TO 300 WORDS OR LESS AND THE COST IS $50 PER ARGUMENT. THE PERSON SUBMITTING THE ARGUMENT MUST HAVE THEIR SIGNATURE NOTARIZED AND INCLUDE THEIR TELEPHONE NUMBER AND ADDRESS.

Cave Creek Town Hall will be open from 6:00 am to 7:00 pm on election day, Tuesday, May 21, 2013.

Voter Registration
Voter Registration is conducted by the Maricopa County Election Department, located at 111 South Third Avenue, Phoenix, Arizona. In addition, mail-in registration forms are available at the Town of Cave Creek Town Hall, 37622 North Cave Creek Road, Cave Creek, AZ 85331.

A person is entitled to vote in the election who has resided within the Town limits for 29 days prior to the election, and who is qualified to register to vote as provided in Arizona Revised Statutes §16-121, as amended and whose voter registration has been received by the Maricopa County Elections Department prior to midnight of the 29th day preceding the date of the election.

Voter registration closes Monday, April 22, 2013.

All Mail Ballot Election
The Town of Cave Creek will be conducting an all mail ballot election on May 21, 2013. No polling place will be provided for this election. A ballot will be mailed to each qualified elector in the Town of Cave Creek beginning on April 25, 2013.

For this all mail ballot election, you do not need to request a ballot. You will automatically be sent a ballot via U.S. Mail. Your voted ballot must be returned by U.S. Mail or in person not later than 7:00 pm on May 21, 2013.

As an alternative to returning your voted ballot by U.S. Mail, you may return your voted ballot in person no later than 7:00 pm on May 21, 2013 to one of the locations listed below or any other polling place within Maricopa County for other election scheduled on the same date.

Replacement Ballot Information
Voters whose ballots are destroyed, lost, spoiled, or voters who do not receive a ballot in the mail, may obtain a replacement ballot. Both candidates were elected with more than 50% 1 of the total votes as of the Primary Election Date.

The purpose of the Primary election is to elect a Mayor and 6 Council Members and to hold a Franchise Special Election at the Primary Election.

Question #1 on the ballot asks the voters whether or not a Franchise be granted to Arizona Public Service Company (APS) to construct, maintain and operate an electrical distribution system in the public rights of way of the Town of Cave Creek, Arizona, and future additions thereto, in accordance with the proposed agreement submitted by the Mayor and Town Council of the Town of Cave Creek, Arizona, to the qualified electors of the Town.
