The Town received three applications for Major Amendments to the Town’s General Plan and is the applicant in a fourth request for a Major Amendment to the General Plan. The cases received public hearing before the Planning Commission at a Special Session on Thursday, June 4, 2009 and before the Town Council on Monday, June 15, 2009.

Case No.: AGP-09-01 (Resolution R2009-10)
Applicant: Thurston
Location of Parcel(s): 3 parcels located NE corner of 48th Street & Carefree Highway on approximately 3.82 acres
Request: Applicant is requesting a change in the General Plan Land Use Map on three parcels from Desert Rural to Mixed Use.
The major amendment, if approved, would have the effect of changing the Land Use designations on the subject properties from Desert Rural to Mixed Use. The requested Mixed Use land designation would allow the properties to be considered for rezoning to any combination of commercial,multi-family residential or single family residential designation, upon application for a Rezoning request and subsequent public hearings to consider the rezoning request.
At its June 15, 2009 meeting, the Town Council voted to continue this case to a date certain, July 20, 2009.
At its July 20, 2009 meeting, the Town Council's Motion to Approve Resolution R2009-10 Failed by a vote of 1-6.

Case No.: AGP-09-02 - Resolution No. R2009-07
Applicant: Town of Cave Creek
Request: The Town of Cave Creek Administration is requesting to change the General Plan Amendment Process. Currently the process specifies that all parcels or contiguous parcels totaling one (1) acre or greater are deemed a “Major” Amendment. The proposed change to the General Plan Amendment Process would increase the acreage threshold to twenty (20) acres.
At its June 15, 2009 meeting, the Town Council voted to continue this case to a date
certain, July 20, 2009.
At its July 20, 2009 meeting, the Town Council voted 7-0 to approve Resolution No. R2009-07 with an amendment to Exhibit 1 to read: "Should a minor amendment be denied, either by the Town Council or by a vote of the citizens of the Town of Cave Creek, the applicant must wait one (1) year from the date of the denial before resubmitting the same application to the Town of Cave Creek.
The change would specify that all parcels or contiguous parcels totaling twenty (20) acres or greater are deemed a "Major" Amendment.

Case No.: AGP-09-03 - Resolution No. R2009-08
Applicant: Pearson and others
Location of Parcel: 13 parcels located South Carefree Highway – North Barbie Lane/Olesen – East 52nd Street – West of Cave Creek Road on approximately 25.03 acres
Request: Applicant is requesting a change in the General Plan Land Use Map from Desert Rural to Mixed Use.
The major amendment, if approved, would have the effect of changing the Land Use designations on the subject properties from Desert Rural to Mixed Use. The requested Mixed Use land designation would allow the properties to be considered for rezoning to any combination of commercial, multi-family residential or single family residential designation, upon application for a Rezoning request and subsequent public hearings to consider the rezoning request.
At its June 15, 2009 meeting, the Town Council's Motion to Approve Resolution No. R2009-08 failed by a vote of 1-5 (with one council person recusing). Resolution No. R2009-08 was not approved.

Applicant: Pew & Lake for Walmart Stores, Inc.
Location of Parcel(s): 3 parcels South of the southeast corner of Cave Creek Road and Carefree Highway
Request: Applicant is requesting a change in the General Plan Land Use Map from Desert Rural to Mixed Use.
The major amendment, if approved, would have the effect of changing the Land Use designations on the subject properties from Desert Rural to Mixed Use. The requested Mixed Use land designation would allow the properties to be considered for rezoning to any combination of commercial, multi-family residential or single family residential designation, upon application for a Rezoning request and subsequent public hearings to consider the rezoning request.
At its June 15, 2009 meeting the Town Council voted 6-1 to approve Resolution No. R2009-09.

Case No.: Z-09-01 - Ordinance No. O2009-09
Applicant: Pew & Lake for Walmart Stores, Inc.
Request: In addition to the Major Amendment to the General Plan request, the applicant has further requested the rezoning of the subject parcels from Desert Rural (DR-43) to General Commercial (GC).
At its June 15, 2009 meeting, the Town Council voted 7-0 to give First Reading to Ordinance No. O2009-09 and gave Second Reading to the Ordinance on June 22, 2009.
A referendum was subsequently filed with the Town Clerk referring the General Plan amendment issue (Proposition 400) and the rezoning issue (Proposition 401) to the public for a vote. At the special election held on Tuesday, November 3, 2009, the citizens of the Town of Cave Creek voted in favor of both propositions, affirming the Town Council decision approving the General Plan amendment and rezoning of the subject parcels.
