Z-20-04 Rezoning Request - Kimley-Horn on behalf of PetSuites

NOTICE OF PUBLIC HEARING PLANNING COMMISSION, THURSDAY, OCTOBER 15, 2020

 

Notice is hereby given that the Town of Cave Creek Planning Commission will hold a public hearing on Thursday, October 15, 2020 at 7:00 p.m. in the Town Council Chambers, 37622 N. Cave Creek Rd and via Zoom conferencing to consider Case No. Z-20-04, a rezoning request to change the underlying zoning of a parcel totaling approximately 1.95 acres from a current zoning of Desert Rural Residential (DR-89) to a Commercial Buffer (CB) Zone.  The vacant parcel is located at the northeast corner of 52nd Street and Carefree Highway and is Assessor Parcel No. 211-47-013A.  An application for a Site Plan Review was concurrently applied for (Case No. SPR-20-01) to allow for the development of a pet resort building.  The Site Plan Review request will be considered following the determination of the Rezoning Request. Copies of the project summary will be available one-week prior to the public hearing at Town Hall and on the Town’s website at https://cavecreek.civicweb.net/filepro/documents/41633. At the October 15, 2020 public hearing, the Planning Commission voted 6-0 to recommend approval of the Rezoning Request to change the underlying zoning of a parcel totaling approximately 1.95 acres from a current zoning of Desert Rural Residential (DR-89) to a Commercial Buffer (CB) Zone.

 At the October 15, 2020 public hearing, the Planning Commission voted 4 in favor, 2 voting present to recommend approval of the Site Plan Review, subject to the Conditions of Approval.

The Town Council will consider the Rezoning Request and the Site Plan Review at its regularly scheduled meeting on November 16, 2020 at 6:00 p.m.  Copies of the project summary will be available one-week prior to the public hearing at the Reception Area at Town Hall and on the Town’s website at https://cavecreek.civicweb.net/filepro/documents/41906.  Instructions on how to view and/or participate in the Zoom platform are included in the Agenda packet.

At the November 16, 2020  Town Council public hearing, the Council voted 7-0 to give first reading to Ordinance No. O2020-09 amending the Zoning on the subject parcel.  Second reading of the ordinance is scheduled for the December 7, 2020 Council meeting.

At the November 16, 2020 Town Council meeting, the Council's Motion to Approve the Site Plan, subject to Conditions of Approval FAILED, by a vote of 0 in favor, 7 opposed.
