SUBMITTAL OF ARGUMENTS:
All arguments for or against the propositions listed below are due to the Town Clerk of the Town of Cave Creek by 5:00 p.m. on Wednesday, May 5, 2020. Arguments must not exceed 300 words in length. There is a $50.00 charge for each argument submitted due to the Town at the time of submittal. Any argument submitted in accordance with Arizona Revised Statues and the Town of Cave Creek Town Code will be included in the August, 20120 publicity pamphlet.
A PROPOSAL SUBMITTED BY THE TOWN COUNCIL OF THE TOWN OF CAVE CREEK TO ADOPT A LOCAL ALTERNATIVE EXPENDITURE LIMITATION - HOME RULE OPTION WILL BE CONSIDERED AT THE TOWN’S PRIMARY / SPECIAL ELECTION: TUESDAY, AUGUST 4, 2020.
A RESOLUTION (R2020-09) OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF CAVE CREEK, MARICOPA COUNTY, ARIZONA PROPOSING AN EXTENSION OF AN ALTERNATIVE EXPENDITURE LIMITATION
Pursuant to the Arizona State Constitution, this proposal establishes an alternative expenditure limitation-Home Rule Option for the Town of Cave Creek for the next four years. Annually, the Town Council will determine the amount of the alternative expenditure limitation for the fiscal year after at least one public hearing. This alternative expenditure limitation replaces the state-imposed expenditure limitation.
A “YES” vote shall have the effect of extending an alternative expenditure limitation for the Town of Cave Creek.
A “NO” vote shall have the effect of not allowing the Town of Cave Creek to extend an alternative expenditure limitation and to require expenditures of the Town to be limited by the state-imposed expenditure limit.
The voters of the Town of Cave Creek in 2016 adopted an alternative expenditure limitation-home rule option. The purpose of this election is for the continued use of the alternative expenditure limitation.
Pursuant to A.R.S. 41-563.01, the Town Council of the Town of Cave Creek voted to approve the proposed alternative expenditure limitation – home rule option at its regular council meeting on March 16, 2020. The vote for approval was 7 For and 0 Against.
At the primary election to be held on August 4, 2020, the voters of the Town of Cave Creek will vote on the question of an alternative expenditure limitation – home rule option.
With voter approval, the Town shall be limited to the expenditure of estimated available revenues whether such expenditures are less than or exceed the State imposed limit. As an example, in 2019-2020, the State-imposed limitation plus applicable constitutional exclusions will allow expenditures of $11,614,290. Under the proposed alternative expenditure limitation, we estimated expenditures of $30,397,132.
If the voters approve, the additional expenditure authority will be used for all local budgetary purposes including General Government, Public Safety, Road Maintenance, Utilities, and Debt Service. Revenues received from federal, state and local sources will be used to fund such expenditures.
